诉讼程序

诉讼程序起始於争端所在及问题的发现,并决定当事人可能涉及的权利为何;本事务所可以提供您必要的协助。 申诉纠纷的期限是自歧视行为发生後起算180天内必须提交到平等就业委员会。 在提交您的诉状後,本事务所将会开始进行诉讼调查,包括: 联繫雇主、面访證人、工作地点到访以及要求提供文件等。 您的雇主将因您的进行中诉讼以及配合就业平等委员会调查程序的缘故,被禁止以反诉的方式对您提出告诉。雇主若有前述行为就是所谓的“报复性诉讼”,雇主将有可能因此被要求负担额外的法律责任。

若案件有州级或是当地主管“反歧视”业务机关的介入,就业平等委员会在60天内将不会采取任何行动以给予该当地机关足够的反应时间。 在某些情况下,到就业评委员会递交诉状有可能会延长至300天。
